Jeffrey Sterling v. George Tenet et al.

Represented a former CIA Operations Officer who in 2001 filed one of, if not, the first racial discrimination lawsuits against the CIA in its history. The initial filing was in the Southern District of New York but after a rare defeat of the CIA’s invocation of the State Secrets Privilege the Court nevertheless transferred the lawsuit to the Eastern District of Virginia where it was ultimately dismissed on the basis of the privilege. The Fourth Circuit Court of Appeals upheld the dismissal in 2005.
