Represented six individuals with the military and civilian system of the Department of Defense who challenged the legality of the Anthrax Vaccination Immunization Program. The 2003 lawsuit resulted in first a preliminary and then a 2004 permanent injunction issued against the U.S. Government that declared the vaccine experimental and prohibited its mandatory use.
The published District Court rulings can be found at 297 F. Supp. 2d 119 (D.D.C. 2003)(preliminary injunction granted), 341 F. Supp. 2d 1 (D.D.C. 2004)(permanent injunction granted). The appeal was declared moot due to Governmental action at 172 Fed. Appx. 327 (D.C. Cir. 2006).
The challenge to the revised program continued under Rempfer et al. v. Sharfstein et al.
