Represented former INS attorney Steven Perlman in a Freedom of Information Act lawsuit seeking the disclosure of a departmental Inspector General Report regarding alleged improprieties of a former INS General Counsel.
The District Court ordered substantial portions of the Report of Investigation released in 2001 after determining the public interest outweighed the privacy of the subject individuals. The Second Circuit Court of Appeals ordered additional information released on appeal in 2002.
A Petition for Certorari was filed and accepted as part of the Supreme Court’s review of National Archives and Records Administration v. Allan J. Favish. Following the Supreme Court’s decision on March 30, 2004, the Second Circuit issue a remand decision on August 12, 2004 affirming its earlier decision.
